Salisbury Township passed ORDINANCE NO. 04-2025-674, adopting regulations to require the testing, inspection, repair, and replacement of sewers and sewer laterals for certain structures in the township including existing non-residential buildings and upon resale of residential builds and to provide for remedies and penalties for non-compliance.
This ordinance, which requires sewer lateral repairs prior to closing, appears to conflict with existing State law. Per the State’s Municipal Code and Ordinance Compliance Act (MCOCA), any repairs required should not hold up closings and property owners should be afforded at least 12 months to comply. Association staff and leadership are actively working with the township to address various concerns with the ordinance.
The township has indicated that, in the short-term, closings will not be delayed.
